Rental Agreement

Please read your vacation rental agreement carefully before you begin your vacation.Any monies received by Torieann LLC, DBA Southern Home Rentals for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

RENTER REQUIREMENTS

For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. Photo ID and the credit/debit card must be present upon check in. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest’s invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest’s invitees.

DOWN PAYMENT/ PAYMENT

For stays thirty (21) days or less, a 50% down payment of the total reservation cost will be required to reserve a property and final payment will be required prior to checking-in to your vacation rental. If booked via AIRBNB/VRBO the down payment and payment supersedes this document for payment.

DAMAGE POLICY

As a condition to the rental of all vacation properties, Torieann LLC, DBA Southern Home Rentals reserves the right to charge the guest’s credit card for any and all uncovered guest/invitee caused losses and damages sustained to the vacation property throughout the duration of their period of occupancy. In the event of any uncovered guest/invitee-caused loss or damage to the vacation property, including, but not limited to, undue cleaning, eviction, service calls, service charges, fines/assessments, repairs or replacements, plus all applicable taxes, Torieann LLC, DBA Southern Home Rentals is hereby granted the right to charge the guest’s credit card. By written or electronic endorsement of this agreement, the guest hereby agrees to pay for all such charges, as defined above and on the proceeding pages.

UPON ARRIVAL

If there are concerns or issues with your rental property, please immediately contact our office (leave a message if there is no answer). No refunds or considerations are given unless we are notified of problems during your stay.

EMERGENCIES/ MAINTENANCE

In the event of a problem getting in the vacation rental or if there are problems with condition or functionality of the vacation rental, please immediately contact the Torieann LLC, DBA Southern Home Rentals office via email at applynow@southernhomerentals.org  or phone 251-423-7321. Feel free to text! Also, we can be messaged via the platform you booked such as website, AIRBNB, VRBO. If it is after office hours, we will make every effort to return your call as soon as possible.

ARRIVAL TIME

Check in is at 4:00 PM. An early arrival of 4:00 PM may be arranged ($40 fee may apply) pending other reservations and the housekeeping schedule. Please contact us prior to your arrival to make these arrangements. Unless you have specifically arranged for an early arrival time, please do not arrive at the property before your schedule check in time.

DEPARTURE TIME

Check out is 11:00 AM. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure of 12:00 PM may be arranged, for a $40.00 fee, pending other reservations and the housekeeping schedule. If you have not arranged for a late check out, you may be charged a fee for each hour beyond 11 am you are still on property, at a minimum of one hour. If the house has not been vacated by 04:00 PM, a fee equal to the rental rate of one day SHALL be assessed.

CANCELLATIONS

Power/ weather related cancellation: Torieann LLC, DBA Southern Home Rentals does not issue refunds due to acts of nature such as: weather, road conditions, snow conditions, WIFI outages, power outages, unforeseeable maintenance issues or forest fires. Booking fees are non-refundable.

TRAVEL INSURANCE

Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. NUMBER OF GUESTS

Change in the number of guests/conduct of guests: guest(s) agrees that more than the number of people stated on the reservation shall not occupy the premises. Unauthorized people at the vacation rental at any time could result in extra charges for each additional guest, in addition to any and all damage, disturbance, and cleaning charges. The rental is not intended for parties, nor gatherings at any time of anyone except those who have paid to occupy the property. Exceptions are made on an individual basis – please contact Torieann LLC, DBA Southern Home Rentals for prior approval. If there is excessive noise or music, any illegal activity, or evidence of violation of these policies, you may be asked to vacate the premise without any refund and additional charges may be assessed. Please inform us of any change in the number of guests before your arrival to avoid these charges and so the cabin can be prepared appropriately for your group. No exceptions or refunds are given for changes in the number of guests after your arrival.

LINENS & TOWELS

Towels, sheets, pillows and blankets are not meant for outside use.

SMOKING

Smoking is not permitted inside Torieann LLC, DBA Southern Home Rentals property. If there is any tobacco smell in the house after your departure, you will be charged a $500.00 fee. Oil lamps and incense are not permitted due to the long-lasting odor. If these policies are violated, there will be a charge for excessive cleaning. If you smoke outside please properly dispose of your waste per the designated location. Only smoke at the designated smoking area. If there are cigarette butts or other tobacco products around the exterior of the property, you will be charged a $100.00 fee.

PETS

NO PETS ALLOWED.

Pets shall lead to eviction of the property. In addition, there will be an additional cleaning fee of $500.00 for cleaning and/or laundry due to any pet fur, or pet excrement not picked up outside. Damages that occur from your pet will also be subject to additional fees or your security deposit being held. (Travel Insurance is recommended)

LOST AND FOUND

Torieann LLC, DBA Southern Home Rentals is not responsible for personal items left behind. If items are found and the tenant/guest wants them returned by mail there will be a $25.00 fee plus applicable shipping charges. Items will only be held for 14 days then they will either be discarded and/or donated.

PLUMBING

Do not put any feminine products in the toilet. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

RIGHT OF ENTRY

Guest(s) agree that Torieann LLC, DBA Southern Home Rentals reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate.

SECURITY & SAFETY RISKS

Always lock doors and windows when you leave the vacation rental! When you rent the vacation rental, you assume responsibility for it and its contents, as well as your personal property. Torieann LLC, DBA Southern Home Rentals does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard except citronella candles in buckets outside, or supplied emergency candles in case of power outage.

SECURITY DEPOSIT

Torieann LLC, DBA Southern Home Rentals hereby acknowledges that {                         } {                        } has deposited with Torieann LLC, DBA Southern Home Rentals the amount of $500.00 ( the “Security Deposit”), which shall be held by Torieann LLC, DBA Southern Home Rentals without liability for interest as security for the faithful performance by guest(s) of all of the terms of this Rental Agreement to be observed and performed by guest(s). If property is booked on Airbnb, the security deposit shall be held by Airbnb. If any of the Rent herein reserved or any other sum payable by guest(s) to Landlord shall be overdue and unpaid, or should Landlord make any payments on behalf of guest(s), or guest(s) shall fail to perform any of the terms of this Lease, then Landlord may, at its option and without prejudice to any other remedy to which Landlord may be entitled hereunder or under applicable law, appropriate and apply the Security Deposit or so much thereof as may be necessary to compensate Landlord for such loss, and guest(s) shall promptly restore the Security Deposit to its original amount upon request of Landlord. Should guest(s) comply with all of the terms and conditions of this Lease, the Security Deposit shall be promptly returned in full to guest at the end of the Lease Term, but in any event no more than sixty (14) days following Tenant’s vacation of the Premises. In the event that Landlord shall convey its interest in the Premises during the term hereof, and delivers the Security Deposit to the transferee thereof, Landlord shall thereupon be discharged from any further liability to guest with respect to the Security Deposit.

INDEMNIFICATION & HOLD HARMLESS

While Torieann LLC, DBA Southern Home Rentals and its property owners strive to maintain vacation properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purpose. All guest(s) and their invitees use the vacation property structures and premises at their own risk. Torieann LLC, DBA Southern Home Rentals and its property owners shall not be held liable or otherwise responsible in any way for injury to any guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and bbqs) furnishings, and/or other equipment, whether by malfunction, misuse, acts of god/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the vacation properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the vacation property and/or its contents. Torieann LLC, DBA Southern Home Rentals and its property owners shall not be held liable nor otherwise responsible in any way for allergic reactions to guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the vacation property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this agreement, guest(s) and invitees hereby agree to forever hold-harmless and indemnify Torieann LLC, DBA Southern Home Rentals and its property owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the guest(s) use of the property.
